Conditions of participation for social media competitions of Linseis Messger\u00e4te GmbH<\/strong><\/p>

1. Subject of the conditions of participation and organizer<\/strong>
(1) These conditions of participation regulate the conditions for participation in social media competitions and any necessary transfer of rights. The description and procedure of the competition will be provided as part of the respective competition campaign on the corresponding pages of Linseis Messger\u00e4te GmbH (hereinafter referred to as Linseis) in the social networks.
(2) The organizer and contact person for the competition is Linseis Messger\u00e4te GmbH, Vielitzer Stra\u00dfe 43, 95100 Selb.
(3) By participating in the respective Linseis social media competition, these conditions of participation are accepted.
(4) If social networks are used to run a competition or prize draw, the operators of these social networks must be fully indemnified. They are in no way connected to the competition or prize draw. Linseis is responsible for the lawful conduct of the competition.<\/p>

2. Participation<\/strong>
(1) All natural persons who are 18 years of age or older and resident in Germany are eligible to enter the competition, unless otherwise stated. Employees of Linseis and relatives of such employees are excluded. Participation with fake identities or with identities of third parties is not permitted.
(2) The opportunity to participate ends at the end of the period specified in the respective social media post.<\/p>

3. Prizes and notification of prizes<\/strong>
(1) Linseis will hold a prize draw among all eligible participants to win the prize stated in the respective social media post.
(2) The winners will be selected at random from all eligible participants after the closing date. The winners will be notified of their win via the comment function in the respective competition post or in a private message via the social network in which the competition was held and requested to contact Linseis to provide the data required for delivery of the prize.
(3) By participating in the competition, the user agrees that Linseis may name him\/her or contact him\/her by private message to notify him\/her of the prize via the comment function in the respective competition post on the social network.
(4) If Linseis does not receive any notification from a winner within one week, the claim to the prize shall lapse. In this case, Linseis is entitled to carry out a replacement draw.
(5) Only one prize is possible per participant.
(6) The prize is not transferable, nor can the prize be exchanged or paid out in cash.
(7) If circumstances arise for which Linseis is not responsible, the respective winner shall accept an appropriate substitute prize. Such circumstances for which Linseis is not responsible are in particular those for which the sponsors of the prizes are responsible.
(8) Unless otherwise announced or agreed, the prizes will be sent to the winner by post to the address provided. The risk is transferred to the winner when the prize is handed over to a carrier. Linseis is not responsible for delivery damage.<\/p>

4. Granting of rights of use<\/strong>
(1) The participant guarantees that he\/she is the owner of the necessary rights to the uploaded or linked photos. If the participant is not the sole author or rights holder, he\/she expressly declares that he\/she holds the rights required for participation in the competition.
(2) The participant grants Linseis the following simple, temporally and spatially unlimited but non-exclusive rights of use to the photo used by him\/her:
a. the right to store the photo on a server;
b. the right to make the photo available to the public in whole or in part via Linseis’ social networks and websites (in particular www.linseis.com)
c. the right to use the photo to promote Linseis products
d. the right to edit the photo, whereby the image may not be distorted.
(3) When using the image, Linseis shall identify the author in an appropriate manner, insofar as this is feasible taking into account the specific form of use.
(4) By accepting the prize, the winner agrees that Linseis may use his\/her name for advertising purposes.<\/p>

5. Liability and indemnification<\/strong>
(1) If the participant uploads photos, the participant guarantees that he\/she will not send any content whose provision, publication or use violates applicable law or the rights of third parties.
(2) The participant shall indemnify Linseis against any third-party claims of any kind arising from the illegality of photos used by the participant. The indemnification obligation also includes the obligation to fully indemnify the organizer from legal defense costs (e.g. court and legal fees).
(3) By participating in the competition, the participant releases the operator of the social network from any liability.<\/p>

6. Exclusion<\/strong>
(1) A breach of these conditions of participation entitles Linseis to exclude the respective participant from participation. This applies in particular if the participant provides false information or if photos or other content used (e.g. comments) violate applicable law or the rights of third parties. The same applies to comments that could be regarded as glorifying violence, offensive, harassing or derogatory or otherwise offend social decency.
(2) If the excluded participant is a winner who has already been drawn, the prize may be subsequently revoked.<\/p>

7. Premature termination and changes<\/strong>
Linseis reserves the right to terminate the competition prematurely in whole or in part at any time, even without observing deadlines, or to change the course of the competition if it is not possible to guarantee the proper execution of the competition for technical (e.g. computer virus, manipulation of or errors in software\/hardware) or legal reasons (e.g. prohibition by the operator of the social network).<\/p>

8. data protection<\/strong>
Linseis is responsible for the collection, processing and use of participants’ personal data, insofar as we process this data ourselves. The Sparkasse will only use the participant’s personal details and other personal data in accordance with the statutory provisions of data protection law. Linseis will only store, process and use the information insofar as this is necessary for the execution of the competition or with the consent of the participant. This also includes use for exercising the rights of use granted. The data will only be used to carry out the competition and will then be deleted. The participant can request information about the personal data stored about them at any time. In all other respects, the
Privacy Policy, which is available at https:\/\/www.linseis.com\/datenschutz\/, applies accordingly.<\/p>

9. final provisions<\/strong>
(1) Should the conditions of participation contain invalid provisions, this shall not affect the validity of the remaining conditions.
